    Default plzzzzz help...bsnl has charged me for free time usage(2am-8am)

    i am using bsnl combo plan in which i have free time from 2am-8am..but on 5th august as i seen in the they started session from 9pm and ended on 6august 9am. so they charged me for my free time usage of abt 2gb and got a huge bill of 2700 instead of 500..so i gave a complaint to bsnl and they said they will put tht in dispute and decide.today one bsnl guy called me and told tht they are goin to charge me becoz my session started at 9pm.i asked them to calculate my free time usage and reduce it from bill.but he sayin he cant do tht .then i said i will go to consumer court.then he sayin he will tell in court than i have done all the downloads durin 9pm-1:59 am so tht he can bill for it.can he prove like tht..its error from their part and still they talkin like this.but i done download only after 2am-8am.but my modem was on fullday.i didnt reconnect.plzz give me ur opinion guys..waitin for tht..

    what bsnl said is correct..........
    its wrong but that is how it happens...........bsnl will charge you from the starting time.......hapenned to me once............but since connection rebooted @ 3 am (my good luck) i was saved......i said this in another post too.......BEWARE....
    BE COOL AND THINK..........what that bsnl guy told you is logical.......don't go to court.......pay the bill and b more careful in future..........

    thanks for the reply....but this is really exploitin the costumer by the provider ryt...?..and i was usin the broadband connection for past 5 months and they charged me like this only for 2 days.usually i never reconnect my modem..but after this happened only i started doin like tht..and wont i get justice if i go to court..??..i contacted a lawyer who is a friend of mine and he said that its nothing wrong in complaining abt this and der is no need of a lawyer if i can i can explain myself in court..wht do u think guys...??

    and also i found in some site a guy sayin tht bsnl agreed to refund the amount after goin to TRAI and consumer court...is der anything wrong if i complain abt this in court..?

    BSNL cannot prove that whatever was downloaded, was downloaded before 2 AM.

    It is also true that you also cannot prove that whatever you downloaded was during the free usage hours.

    So it will be stalemate.

    But if you can prove that you had consistent download habits in the last 2-3 months and shor the log where most heavy download was between 2 AM to 8 AM, then you have a chance in the court. So no harm in disputing the bill further and going to court.

    From total usage free usage and Chargeable usage are 6 hour each.
    So you can claim 1 GB as average free usage.
    Same way for the other day's over lapping usage.
    What the summary at the top shows ?
    Chargeable usage ( excluding night usage )

    first of all thanks for this useful information guys....and just4kix was sayin tht it will be a stalemate..but its all occurred due to their wrong calculation becoz they didnt calculate the free time separately...so its error with der software and error from their part..they should be correct from their part if they want to claim something in court..ryt..

    and guys can u say some more information which i can claim in court..

    At present bsnl cannot log what is downloaded before 2 am and before 8 am if your session started before 2 am and session ends after 8 am. so, in our own interest we must disconnect before 2 am and connect after 2 am and disconnect again before 8 am and connect after 8 am to continue.
    Do you have any evidence to show that your download started after 2 am and ended before 8 am? Then you may succeed in consumer forum anyhow, there nothing wrong in trying a case against bsnl in consumer court. Contact a good advocate who has a good knowledge in information technology with all facts and follow his advice.

    thx again...i dont have any proof to show tht my download started after 2am.but they are the provider and they should provide proof tht i have done all this download before 2am..ryt??..why should a consumer think abt these technical details like how they calculating and they didnt say anywhere tht we should switch off and swith on the modem at 2 am while givin connection or anywhere in their site..they just charged my free time usage also..they have to remove it and they cant do tht with the information they have..so guys dont u think i have a good chance of winnin the dispute in court..its error from their part ryt..

    Strictly speaking, It is the obligation on the part of the service provider(BSNL) to log what was downloaded at what time and certainly it is true that consumer is not supposed to know or aware of all these technicals. But, if something goes wrong we the consumer has to suffer which is the case here.

    Regarding the chances of winning a case before the forum, you dont have evidence to prove to conclusively that download is done between 2 am to 8 am at the same time they (BSNL) cannot show that is downloaded beyond freetime, so, there are chances of winning the case in your favour. But, it is better to take an informed decision based on experts advice that is why i suggested to contact advocate

    man consider ur self lucky , i know people who had to pay 22 K for this

    but still, good luck with the case , i hope those brats loose

    1.
    Welcome to Bangalore Telecom District website
    be brief and give your STD code userID 14 digit portal ID etc.
    refer the dates ( for full month AUGUST)
    2.In the meantime download the full usage details and keep for your Court case use. ( If case comes up in next March 2009 ( hopefully ), details will be lost )
    Usually BSNL goes by usage pattern ( like for excess telephone STD wrong bills ) and may waive this amount.
    Para two: Presume you are not using a wifi router.
    Also you have to send complaint to higher BSNL authorities ( with copy to local exchange or A.O )and have records , that they did not respond to your complaint/grievance. This is also required to go to Consumer Court in the first instance . You could even claim Rs 1 Lakh for deficiency of service.What CCourt gives you will be different or "peanuts!"
    A recent case ( dragged on for more than an year ) with another ISP widely discussed in IBNCNN TV resulted, I think,
    in the user getting a compensation of about Rs 5000/=, and the ISP disconnected the BB service to him.
