^ perhaps you are mistaken . is it 256kbps home 500 plan !
    we see the speed in Kilo Bytes (KB/sec) . 256 kbps = 32KBPS .
so this 32KB/sec is the maximum downloading speed available .

Actually we should get atleast 28KB/sec ...

^ promissed speed is 32KBPS . And we should
get atleast 28KBPS . The speeds depend on
many factors ( server capability , load on server ,
    line condition ... etc ) .

And sometimes at early morning I get about 40KB/sec .
yesterday afternoon few dataone users reported more
    download speeds ( > 100KB/sec )

Well i have same 256 KBPs home plan and i got 30 to 32 kb/s speed when i used it download some files from net.

If we talking on uploding than its bad performance by BSNL. Only few sites allowed more than 50 kb/s speed otherwise it is slow.

If you looking for the speed of dataone which others are getting in there area and you wana compare the same with yours then i would say ther won;t be much of a difference as dataone provides the same bandwith to all major cities in India. They are no prefrences given to anyone. However if you experiencing a lso download/upload spped it could be because of your own system the one on which you wroking.
