    Default are torrents legal?

in todays date so many torrent sites are springing up.and possibly every thing under the sky can be found on torrents and file sharing sites.from latest music albums to newly released movies, games or even softwares that cost lacs of rupees just takes days from their release to get uploaded through torrents as DVD rips or TV rips.

a popular site named isohunt is facing legal problems for posting torrent links.the EU governing body has taken action against it and it is pending trial some time later.a woman in the US was fined millions of dollars for downloading illegally.
my question is if torents and file sharing is illegal how come billions of people around the world are using it without any fear of any sort.seems like every other person is using it.is the indian government doing anything when it comes to torrent monitering?

It depends upon what are you downloading. Many Open Source software are available through torrents so that these organisation can save their bandwidth. You can point out examples of linux Distros available through it.

Also for copy righted things I would like to point out example of Sweden where Pirate Party had become the 3rd largest party & had also bag seat in EU elections. All torrents in future are going to be legal.

Also you can never be caught that easily if you take appropriate steps as given by me in Computer Security Steps. That women was greatest fool who was seeding to all even authorities who caught her. In India no one is going to caught for at least 5 years more.
Use method given by me & always use force encryption option:-

Torrents is a method. It is quite legal. Legitimate stuff like Linux are widely distributed through torrents. But if you download latest hindi movies using torrents, it is similar to buying a pirated CD, which is illegal to sell or buy.

It is just like a pen. Using a pen is legal but not if you are writing threats.

    Meetdilip said it right.

Torrent is a method of distributing content over the internet using peer-to-peer networking. It is perfectly legal to use this method, if you own the distributed content and/or have full rights to the distribution.

But over 90% (if not 99%) of torrents on the internet distribute illegal content (movies, music, software, eBooks, etc.)

i am sure u can download as much as u want for now, as not many laws exist in india to prevent the downloads and use of pirated things.i mean comeon, how many of personally know any one who has baught a copy of Windows OS from Microsoft as a standalone install????
i am sure when buying new laptop/desktop from branded companies u might end up getting an legitimate copy of windows but , what about another millions of pcs which are assembled or homebuilt?? do u really think that all off them have baught a legitimate copy of the software (except for corporate/companies/buisness users).
even the law mostly targets people using pirated software in commercial properties.
it is quite impossible at the moment to stop piracy and use of torrent downloads at the moment and for another 10 or so years in india/china.
just think it this way if all the windows pc in only india/china were to buy a legitimate copy of Windows os bill gates would be so reach that he would have to buy himself a new planet to store that money....

    Agree with you.

But I am the one who purchased a legal retail copy of Windows XP/Pro. I also have legal copies of software that I use except for one or two (which happens to be installed on my desktop but I am not using for the last 4 years).

But this post is going slightly offtopic.

I used to have an illegal copy but I got fed up of the security holes it had and I was unable to download the latest updates, etc. I could have got another illegal copy but I thought otherwise.

it is illegal for sure.. you may not get caught in most of the cases but.. it is not legal and ethical if you would ask me.. i rarely download anything using torrents... things are already cheaper these days why not buy them
