COPYRIGHT some viewsINTRO
This article is the result of some views expressed here, about copyright of posts content/s in posts/ guide/s etc.
Usually in an open forum, @admin does not subscribe to the views/opinions/ ideas etc , and no liability arises like damage to equipment /system/loss of data etc , by a member using the suggestions here. An example will be the "EULA".
In some cases, @admin ( not this forum ) has deleted adverse views /comments about an ISP their services or products,
even though theoretically it is the member who is responsible for the contents & given the"copyright".
PLAGIARISM
Recently an Indian author wrote a book with Copyright by the Publisher. and became a best seller. But unfortunately, vigilantreaders pointed out "wholesale" copying of similar paragraphs
/chapters from an earlier book, and the author(ess) had to admit her"guilt" and was disgraced. In this case Copyright fails.
Originality
The same idea can occur to two different individuals, but the advantage goes to the first person who "published"the idea, (specially Patent cases )
Classic Example: who thought of Wireless?
Marconi or Tesla or some Russian ( Name ? TOPOV) or Dr. JagdishBose in our country ( correct name ?)
Satellite transmission by three geostationery satellites through out the world was conceived by ArthurClarke and published in Wireless World ( 1942 1952 ??)
he never patented or "copyrighted" his idea, and did not get "royalties " etc.
MUSICAL scores /songs
A reproduction of the original tune/soundtrack for more than 40 or 60 seconds infringes copyright and even Late Michael Jackson has paid heavy damages,in a recent case.
( forget about our music directors and Lyric writers.
The original authors neither have the will or patience to indulge in endless Litigation in our courts!!!)
"Imitation is the best form of flattery"
PATENTS
similar to copyright, this has affected our traditional knowledge base of use of herbs etc for medicinal use.
Case of "Turmeric" some one in U.S patented it for anti bacterial use, and Indian Govt had a hard time challenging the patent!
( it was done by a Desi Indian!)So in our country
most knowledge was not preserved in printed form , and source " discovery" is a Herculean task .
COPYRIGHT
It requires a Legal Notice in various newspapers tocopyright a " Name" BrandName"
or an article or book ,and legal route is tedious.
So if some members are talking about copyright , others can take it lightly.
Consult a Copyright & Patents Attorney before brandishing"copyright" here !!!
