Thread: Consumer Courts ? Urgent Help needed Please.

Does it matter if the company is a really big company to file a consumer court case online against ?

I want to file online consumer court cases against eBay India & eZone ( Futurebazaar ) .

Is there any hope to win over them ?

1) eBay India :- I have paid ( 17,798 + 24,810 + 23,199 ) = Total of 65,807 INR.

I have E Mail proofs from eBay that i have paid for the sellers as you may know eBay sends E Mails to the buyers when they buy anything in eBay.

But eBay is now saying they DID NOT receive my payments despite that i have sent them every proofs that i paid them using a Prepaid Debit card through Paisapay.

2) eZone/Futurebazaar ( Buy Mobile Phones, Digital Cameras, LCD TVs, Laptops, DVD Players, iPods & Air Conditioners at eZone ) :- Total loss INR 59,040. I have bought 3 items & received only 1.

I) They charged me 11250/- for a Seagate External 1 TB Hard Disk which is avilable anywhere in the market for 7300 to 8500/- .So, they charged me more than 3950/- for a 8500/- worth of product.And to add to injury the product came DOA ( Dead on Arrival ) .i called & E Mailed them several times but they are not giving me my money back.

II ) I bought a Dell Laptop worth 42,990 from eZone using a Prepaid card & they told me that they will be shipping me my Laptop soon but on the same day itself , i logged-in to my eZone account & found they cancelled my Laptop order.When i called , someone put me on hold for 30 minutes ( That's 30 Rupees STD charges ) & told me that my payment was not processed.so, they cancelled my order & told me that they will be refunding the money back to my card but as everyone knows that Prepaid Virtual Cards can not get refunds on them so i've lost all the money spend on the laptop.I ordered the Laptop after confirming with them that i can pay with Prepaid cards & they also told me that the Laptop is in stock.

III ) I also bought 1 4GB Ipod Shuffle which is showing as shipped but i have not got that yet.

I want my full money back through cheque or Demand Draft or Money Order from both eBay & Futurebazaar.Or if money back is not possible then i will want to receive the products which i have paid for with my hard-earned money.I run a small shop in my house ( Compu - World ) & these amounts i have paid were the orders for my customers.I have paid eBay & Futurebazaar with a Prepaid Virtual Card after confirming with them that buying is allowed with a Prepaid card.Now , if eBay & Futurebazaar don't provide me the products or give me my money back , that simple means i will have to pay the damages to my customers from my own pocket.And why should i do that ? I'm not that rich that i can bear a loss of nearly 1.25 Lakhs. I myself need money for my Transplant.

Please suggest me what will be the exact procedures i should take to file an online court case against them.Any help will be highly appreciated.I know Admin won a consumer court case against whirlpool.So, i will be looking forward to what he suggests me to do in this.

I am not sure how we can handle this situation as I am not a lawyer and the best thing to do would be to go to your nearest consumer forum and talk to the employees there and see what they say and if they can recommend a lawyer as they know which lawyers are good at what. You can also represent yourself if you know what you are doing.

I dont know how you would file a case online because the only way I know is by going to a consumer forum physically and writing a complaint on paper.

It will be helpful if i could do it online as i'm on Dialysis now and my doctor has suggested me not to move out of my house for at least 2 months.

I found that there are several consumer forums online.Can not i post my issue there & expect a preferable solution from there ? Thanks for your reply.

Consumer forums you are talking about are product review websites and do not have any authority as such and the information posted there is for other to read and some companies come around on those forums to resolve issues where they can but other then that if you want legal intervention you would need to file a case at a consumer forum (not online) You can hire a lawyer to represent yourself if you are not well enough to go yourself but you would need to submit doctors notes for that.

file your complaint online at ccccore.co.in. It says on the websites that its supported by Ministry of Consumer affairs

well, if you have the proof, feel free to go to consumer court.

You can also ask for more money as a compensation for troubles you faced and no deliver

Well the case now is , eBay permanently suspended me without giving me refunds for my payments & also no deliveries.I think they might came to know that i'm trying to ask for a justice in some forums.I asked them the reason of banning me & those suckers only had to say this " For specific eBay policy we can't tell you the reason " .What the heck ? They ripped me & banned me because i wanted a justice.Well I think eBay just don't give a Damn about anything even though thousands of people are complaining everywhere against them.

In the case of the Futurebazaar , i got two products but the main big investment which was a 42990/- Laptop has not delivered to me & they are saying they sent me refund on 30th August but I did not receive that till today.

I'm now fed-up with Indian websites & I have bought two Legal Street addresses in UK & the USA.So, I think i will buy from USA sites next time.At least they will not run away with my money.
