    Default traffic police new rule - read must!

    Please confirm in your states.

    If you are getting caught quite often by Bangalore's traffic police, then this will be the article you cannot miss out on. From now onwards, the Traffic Police cannot catch a motorist just to examine the driving licence or vehicle documents. He can catch you only if you have violated any traffic laws or if you are driving drunk.
    Remember that when caught for traffic violation, the fine you pay must be limited to the violation. In other words, the police can't bloat the bill saying that you have no insurance cover or emission certificate, etc.
    Many motorists do not know this. According to the State's Road Transportation Act, no policeman can slap a penalty on you just because you have no insurance or emission certificate. If you have not purchased insurance cover for your vehicle, then the police officer must issue a notice, not impose penalty. You must be given 15 days' time to purchase insurance cover and one week for obtaining the emission certificate. Days later, meet the sub-inspector at his station with the insurance cover or emission certificate, so that he will annul the charge at once. Police can fine you only if you fail to produce these documents within the stipulated period. If your vehicle is brand new, then you need not bother about obtaining the emission certificate for one full year.
    In response to a question as to why policemen fine people instantly without giving them time to obtain insurance cover or emission certificate, Additional Commissioner for Traffic Praveen Sood said, "Yes, it is a mistake. People must force policemen to issue notice or complain to me at least the following day. I have suspended the Indiranagar sub-inspector for catching people for silly reasons," he said.
    The best way to teach the police a lesson is filing a written complaint with their higher officials and, a week later, using the Right to Information Act (RTI) to know the action taken against them.
    Remember, any question or application filed under RTI cannot be ignored and no official is bold enough to ignore the RTI Act.

    but it can be misued as well. By the looks of it, earlier they used to get hold of ppl,get bribe n send them away.. but now they will be forced to cook up an excuse and file complaint on u, just to get bribe...

    as they have mentioned there they cant even file a case directly, they have to give warning.

    I am searching an authenticated proof about this. As soon as i get it ill post here.

    wat i mean is they can catch you and tell u pay bribe or else threaten you tat they will file a (false)case tat you were drunk or sth like tat. Obviously it cannot be verified by anybody later,.....

    For drink & drive they have to take you to the hospital and get a alcohol test done, else even they cant file case on you

    hopefully the traffic scene goes better now in bangalore......

    well i dunno about nyone esle but I neva drink n drive ......no matter if I ve drank jus half a glass or more ......but I dont c a point in risking my life, my car's life n ppl's life as well.....(in my car & outside as well).

    I suppose alcohol content is there in your body can be shown up in 24 hours
    Dont count wat u lost, cherish wat u ve & plan wat to gain...coz past neva returns but future may return the lost! Think-Decide-Act!!!!

    it can be detected till 36 hrs but according to our rule the test should be made within 1 hr.

    Here in chennai these people have competition zone wise and station wise who collected more and just for silly reasons they fine people to increase their collection, its very common here every month or alternate month they will have this ritual.

    Once they stopped me while i was driving car, checked all the documents and then he is asking what was your speed, i said it was something around 50kmph he started arguing and started to cut fine to my surprise he said i was driving at 80+ kmph, when asked how come you know that he is saying i am having so much years experience i can judge the speed. :lol:

    It is same in Delhi but unfortunately only 2% of total population knows what is RTI Act and how to escalate matters.
    Riding/Driving without insurance or PUCC (Pollution Under Control Certificate) is not good but still cops can not force you to pay fine on first violation.

    Actually it is not too far fetched. Police officers are trained to estimate
    speeds visually. I am not sure about Chennai, but abroad the officer
    can testify that in his opinion the driver was speeding.

    In other countries this may be true but here i dont think they can do that. Here police is not so well trained or careful they are just bunch of lazy guys thats all.

    i dont think here in india they are trained to that extend the guy who made me stop was a stupid constable seemed he knows nothing and the senior officer he was busy in collection competition.

    the joke is they had the jeep which was fitted with the instrument to monitor speed but seemed they where not trained to operate that because it was kept covered with cloth :lol:, they were too confident of their visual training.

    Nice info!!!

    How will police come to know that one is driving drunk without catching the person?
    Don't you think it's a Catch-22 situation?
