Default Legal notice and arrest warrant threat from Reliance broad band

I terminated my Reliance broad band about 2 years ago due to problems with connectivity
During my troubleshooting at that time they said that if I buy a static IP all my problems will be solved, so I agreed and once static IP was assigned the problem was not solved.
I disconnected the connection and refused to pay the amount of Rs 2000 as it had not solved the problem.

After 2 years I get a call from Delhi saying that they are going to file a case against me and he said pay Rs 3000 for the bill or get ready to pay Rs 75000 as penalty. And that they are going to issue an warrant against my name for appearing in the court to the police head office.

Any body has seen this kind of issue ? it is they are just trying to scare me or there is something else. If anybody has got out of such a situation please let me know

Welcome back. It has been a long time since you posted.

As far as your case is concerned, do you have copies of prior communication?

There is no way that Reliance (or any other company) can force you or threaten you in such manner. You should write to them stating what your problems were at that time, enclose copies of communication, and tell them about the dissatisfaction in service. Tell them that they promised to resolve an issue for a fee and they failed to resolve it. Do not allude to non-payment at all. Tell them that they should fix the problem first.

And you should also tell them that they should stop, nee desist, from threatening you. If they continue, tell them that you will be forced to file a case in consumer court. Do not use strong/threatening words yourself. Be very polite but very firm.

    Send such a letter by UPC/Registered Post/Courier.

p/s. I once faced such a problem with Standard Chartered Bank. They gave me a free credit card and next year demanded annual payment of Rs. 3600. I refused and told them I do not want the card. I talked to the customer care. They promised to cancel the card and close the issue; but they didn't. The bank kept demanding and sending bills for six months. The amount rose to Rs. 6000+. They even sent a collector to my home (I told the collector that if he comes to my society again, I will have him arrested by the Police). I then talked to the customer care, explained the situation and told them that I will take them to counsumer court for harrassment. Then it all stopped.

Unless you have a uncle who is an advocate who can pursue in court free of cost( min fee Rs 5000 advance for a lawyer )
or you have your own goondas to beat up their collection agents who will knock your doors at odd hours or call and threaten your family
you are better off bargaining and pay the amount Rs 3000( ask 50% discount)
If you have written proof (registered post with proof of delivery)about poor service and receipt with signature for surrendering their equipment,
then file in consumer court immediately if you have the time.
No need for lawyer to file in consumer court, they will run away from you and never bother you.

    @ ulysses

I strongly disagree with you on paying the money that the OP doesnt even owe them. I have an ongoing issue with them myself and they have been demanding Rs4k something from me and I believe I dont owe them anything instead they owe me a few hundred rupees as the service wasent provided for the entire amount I had already paid. I have had the collection agents knocking and everything done with and now some lawyer sent me a notice few days ago asking me to appear at his office which I just ignored as he is no authority to ask me to come to his office and I am getting calls every 4-5 days now asking me to pay up which I keep telling them I wont because I dont owe them any money.

Rs75000 as penelty? I wouldn't stop laughing if they said this to me. I still have their equipment as I refused to return it unless they send some one with an identity card and a written document duely signed saying I have returned the equipment because I know these guys too well now. I havent refused to return it back its just that I wont give it to any tom dick or harry to find out latter that I dont have any proof of returning it. If they do send some one over I would actually make a video of the whole thing and also keep a photo copy of the identity card of who ever comes in. No ID with the guys would mean that I am not even talking to them

The notice I recieved has D&A Associates written on it and has a Delhi address. Mine is for Rs4165/-

I dare reliance to make me pay up this amount that I don't even owe them and I will one day get the money from you guys which you have wrongfully charged me and havent provided the service you were supposed to.

    Admn:

you may have bigger muscle than the original poster to argue with the people who knock or preparing to appear in court if they do send summons.!

I spend lot of time in all types of court. ( Imagine 10 lakh fine on a tax case pending in Apellate Tribunal!)

best solution is to have written complaints ( even email sent -print copies) of the defecient service and threaten Reliance in return that you will go to consumer court and then file there indeed if their harassing does not stop.

once consumer court case is on,court ruling is binding.

reliance is bluffing to see whether this guy blinks.. 75k fine threat only if he does not pay rs 3k!
I doubt they will go to court. They are checking whether the poster is as tough as you are!
I think collection agency has already bought all the uncollectable at 25 cents to the $ or less.
so whatever they collect is a huge profit.

so far they are bluffing, if they had a case, they would have filed already and you will get court summons .then you do need a lawyer ( only in consumer court no need lawyer)and I am getting calls every 4-5 days now asking me to pay up which I keep telling them I wont because I dont owe them any money.
you do have patience to answer nuisance calls at all hours.

The notice I recieved has D&A Associates written on it and has a Delhi address. Mine is for Rs4165/-

continue the same path. I think they wont waste time going to court. they will give up soon
but be prepared if you get court summons ( not asking to appear in lawyer's office .Ignore any letter in lawyer letterhead. )but court summons ..ok you need to go.

I guess I would compliment the people calling me about the patience they have shown even after I exausted my dictionary of Hindi and Punjabi "Galis" I have never hanged up on them... they do when they realise that they have a hard nut to crack on the other end Its funny when some one calls up and says I am Inspector so and so and calling from so and so police station and I answer back saying to call kya apni maa chud*** ke liye kiya hai yahan? and there is a long moment of silence and I tell them to stick their threat in one of the holes they have... So this is how most calls end with the guy on the other end hangging up saying ruk tu jara tujhe dikhata hoon mein I am waiting to see what exactly are they trying to show me... Its been a few weeks now and no more calls... they have probabbly put a note against my number saying heart patients dont call this guy ha ha ha.

They have stopped calling and sending letters now and they have no grounds to go to court... Their stupid equipment is still with me as they never sent any genuine employees to collect it probabbly because I told them I would need a no dues letter in exchange

    Reliance can stick it.

The funny thing is that I still use a Reliance prepaid netconnect broadband thing and that one works like a charm every time I connect

I will go with Ulysses on this issue.. untill and unless you have a very good lawyer in your home pls dont bark upon them.
the admin of this website and other "ganmanya' people in this forum are lot powerful.. they have a very good backing. they can strive and wont shiver at all.
but as a common man if you are such, you cannot just make things like you want.. you should respond to the legal advice immidietly if your issue is really very serious. whatever charges he may take, but he will give you the best advice and look for someone who will listen to you thoroughly and your position.. better look for a cyber expert on this issue if you can(there are many in metros)
Site from home gaya bhad mein... AIrtel se bolo FUP band kare.. BSNl se bolo 3G signal do!!!!>: (

Cool Nothing to worry a about you can make money on this do as I suggest

1.Catch lawyer and send legal notice to reliance broadband including whole Adag group for breach of contract and failure to provide services and ask for compensation.

2.Send second legal notice after 3 days for compensation for mental Harressment and criminal intimidation from reliance broadband.

3.Ask for compensation over one crore failing so issue will be take to legal course and also will be displayed in media for education.

4.Ask for written apology from top managment including all in city.

    5.Watch fun.

No need to worry they do not have balls to go court for such small things.
