Default Ping flooding Upstream bandwidth

I'm able to ping tata ip addresses with large ICMP packet size > MTU (packets get fragmented offcourse)

ping <tatabroadband ip> -l 40000 -t

or

ping tataindicom.com -l 30000 -t

this won't crash target machine because ping of death is ancient and all Os are patched but this definitely DoS/DDoS due to upstream bandwidth congestion.
