Exactly what are the laws on this? Can the hosting provider get punished if something illegal takes place on their servers? Also if the customer has signed a contract saying that all content hosted must be legal to Indian laws?

You are right to an extent but when it comes to laws they are a bit stupid when it comes to cyber laws ... we still do not have well defined cyber laws.

Even if you get a signed contract with your client saying they know hosting porn is illegal or piracy and so on ... You still would be held liable for anything illegal that goes on. I am not a lawyer and I am just repeating what I have been told by a lawyer so it would be better if you confirm this with someone.

As an Indian businessman I saw in few years that people make websites as an amateur not as a professional.

Although I am selling domain name reseller and web hosting reseller but I have few government and non government clients..and I found that IT in India is nothing...although America is totally or fully dependent on India about IT.

hardly 15% - 20% of the total population understand what It means and

1% - 2% of the total population know what is the basic difference between website and internet..

Yes admin, I think you are very correct with Manashosting. I dont really know about the reseller stuff, but i got into a tangle with them taking their domain registration and then their hosting package. I applied for domain registration on 26th may, and i still cant re-direct my blog to the domain i purchased. All that i needed was CNAME records working, and after buying thier stupid web hosting package too, i still dont have control over my control panle. Very poor service.

After reading the reviews about Manas Hosting, I was cusious to check out their website, but unfortunately the site isn't responding. After checking it out with some people, I heard that Manas Hosting was once one of the leading web hosting service providers here in India, I wonder what went wrong, is anyone aware of this?

To start with let me tell you web hosting is nearly nonexistent in India and I am not talking about the resellers who are from India but sell hosting in servers in US.

There are a very few companies which provide web hosting in India. The main reason being low prices of US competitors and at the moment it doesn’t look like this is going to change in the near future. The main problem with starting a hosting business in India and setting up a data center is the government of India which just doesn’t know how to keep up with the technological advances the world is making. I would be the firt one to set up a small data center some where near new Delhi if the govt becomes a bit reasonable with the licensing and stuff and does away with this stupid pornography laws. The day government of India wakes up from its long sleep and makes porn legal it will give such a huge boost to the economy given the potential of web hosting business which is driving force behind the Texas state's development in US and its all due to the favorable government policies and cheap bandwidth.

Some of you would say whats allowing porn got to do with web hosting, well porn industry constitutes a major chunk of internet traffic and if porn site hosting is not allowed by the government in India that business is lost straight away so demand decreases even before I start up my web hosting business and that kind of brings and end to the plan as according to some estimates more then 50% traffic is adult traffic and if India chooses to turn a blind eye to it then it wont take many guesses to find out who is loosing out.

thats true, as of now we are leasing servers from various data centers in US because of high costs in India

India doesnt have a proper webhosting company.Most of them are resellers.
Better use hostgator or hostmonster.I use them.They are reliable.You also dont have legal issues if you are hosting on U.S servers.

It's true that India has mostly resellers but they add value to the chain by providing local support which hosting companies in US cant, moreover there are many people who would rather deal with someone who is local then abroad.

This would be an injustice to the companies that aren't resellers of any other webhosting company. I am aware of some companies who actually own the server and other hardware.They have their own support staff at the operational areas and the DC's to carry out the web hosting related tasks.

I didnt mean to say there are any webhosting companies in india.
My personal choice and preference are U.S companies.They are cheaper n reliable.

@speedhost Most problems are sorted via email in minutes.You got live chat in reputed webhosts.So the issue of dealing problems locally hardly arises.

Dude , hosting site in americen server might not be safe as all info can be monitor by their agencies which are known for human right violation but Indian infrastructure is in shambles.

@kooldude: true, most US based companies have 24/7 chat but they dont accept cheque or netbanking as money transfer options which very important to a Indian customer.

@speedhost Most webmasters are aware of paypal.so why do you need netbanking or cheques.paypal is more secure.

It all depends on three factors before you choose an Indian or US based server hosting

1. Network uptime & Support
2. Target Visitors ( US or India)
3. Price

I would say if you are targeting primarily visitors from india and if there is a good provider around you should host locally.
